It would be recalled that the House has been hosting meetings between the government and the strike lecturers in the past couple of weeks.

On Friday, the Court of Appeal agreed with an early ruling by the National Industrial Court that asked the Union to resume immediately.

It would be recalled that President Muhammadu Buhari had during his budget presentation stated that N470 billion has been allocated for tertiary institutions in the 2023 budget.

Speaking on the outcome of the closed-door meeting, Gbajabiamila said President Muhammadu Buhari will make a major announcement regarding the strike.

Strike: ASUU holds crucial meeting over Appeal Court ruling

Following the ruling by the Appeal Court, ordering the Academic Staff Union of Universities, ASUU, to suspend its 8-month-old strike with immediate effect, the union would be meeting on Sunday (today).

Recall that the Appeal Court on Friday ordered the striking lecturers to obey the earlier judgement by the National Industrial Court which ruled that the union must suspend its prolonged industrial action while negotiations continue.

Goldennewsng recalls that ASUU on February 14, this year, shut down public universities across the country while demanding for the full implementation of earlier agreements between it and the Federal Government.

But following fruitless efforts by the government and other stakeholders to reach a truce with the aggrieved lecturers, the President Muhammadu Buhari-led government, on September 11, dragged ASUU to the National Industrial Court.

The court, on September 24, ordered the union to return to classroom while negotiation with the Federal Government continues.

But miffed by the ruling, ASUU headed to the appellate court to appeal the ruling.

However, the Appeal Court, while delivering a judgement on Friday, ruled that the union must obey the ruling of the lower court and call off the strike immediately pending the determination of the substantive suit.

Appeal Court to rule in ASUU’S request against Industrial Court Order

The court of Appeal will on Friday, October 7, deliver a ruling in an application by the Academic Staff Union of Universities, ASUU, seeking permission to appeal against the industrial court order.

The industrial court had on September 21, granted interlocutory order in favour of the federal government, ordering the university lecturers to resume work pending the resolution of their dispute with the government.

Dissatisfied with the lower court’s order, ASUU through its counsel Mr Femi Falana SAN, filed an application at the Court of Appeal, Abuja seeking the leave of court to file an appeal against the industrial court order.

Falana claimed that it is the right of his client to file an appeal against the interlocutory injunction because it is against them.

Falana cited several authorities to the effect that ASUU must first seek and obtain leave of the court of appeal before filing a notice of appeal so as to ensure it validity.

The senior lawyer informed the three-man panel of the court headed by Justice Hamma Barka to reject government opposition against the application, adding that it will amount to a dangerous decision for his client to be denied the right of appeal.

Earlier, Falana had requested that the stay of execution of the ruling of the industrial court, contained in the application, be discontinued.

However, in vehement opposition to ASUU’s application, the Federal Government prayed the court to dismiss the entire application on grounds of incompetence and jurisdiction.

The Federal Government’s lawyer, Mr James Igwe SAN drew the attention of the court to the fact that the Industrial Court order made on September 21, has not been obeyed by the lecturers to date.

He also opposed the decision of ASUU to jettison the stay of execution of the Industrial Court order adding that both parties have already joined issues.

The senior lawyer argued that ASUU, having been in contempt of court, cannot come before the Court of Appeal with unclean hands to ask for a favour or attention of the court.

ASUU strike: Confusion, uncertainty as FG issues license to CONUA, NAMDA

Hope of the quick resolution of the labour dispute between the Federal Government and the Academic Staff Union of Universities, ASUU, deemed on Tuesday as the former went ahead to register parallel unions in the academic community.

It is, however, uncertain how the government’s action could lead to the re-opening of the public universities.

The move, which is seen as an effort to break the ranks of ASUU, came after a National Industrial Court had also earlier ordered ASUU to return to work, a judgement ASUU has appealed.

The FG had last week issued a circular directing Vice Chancellors to re-open the universities. However, it was understood that following interventions from stakeholders, including the leadership of the House of Representatives, the order was withdrawn.

As the industrial strike embarked by the Academic Staff Union of Universities, ASUU, enters its eightieth month, the Federal Government has warned the union to cease from acting in defiance of the interlocutory injunction given by the National Industrial Court (NICN), which restrained the union from further action.

Senator Chris Ngige, Minister of Labour and Employment, gave the warning in a statement signed over the weekend by the ministry’s Deputy Director, Press and Public Relations, Olajide Oshundun.

However, Ngige said that ASUU should stop taking laws into its hands by directing its members to continue with the 8-month old strike.

Recall that the Speaker of the House, Femi Gbajabiamila had last week called for an extended meeting of all stakeholders in the education sector to resolve the over seven months strike.

The Accountant General said the government will accommodate the union on the issue of salaries in a bid to end the strike.

He insisted that the government is concerned over the ripple effect of allowing ASUU to have a separate payment platform from others.

“If there are peculiarities in the university salaries system, what we need to do is to sit down with ASUU and identify them and address them in IPPIS. We are willing to accept.”

This is the third meeting brokered by the House of Representatives, like many others, the meeting did not yield any agreement.

He slammed the Minister of Labour, Dr. Chris Ngige for dragging the union to the National Industrial Court, NIC, while President Buhari and other government officials are interacting with the union to resolve the eighth-month strike.

He said, “All Nigerians can see that the government is not interested in resolving the issues. Like I have said, these issues can be resolved in just one or two days.
